Abstract

ABSTRACT NUR HUSNA SYUKRI, NIM. 15030103024. "Overview of Islamic Law Against Implementation of Government Regulation Number 60 Year 2016 (Study of South Konawe District Police)" Through the Guidance of Dr. Ipandang M. Ag as Counselor I and Mr. Drs. Muh. Idris Ma As Advisor II This study discusses the Review of Islamic Law Against the Implementation of Government Regulation Number 60 Year 2016 Regarding the Types and Tariffs of PNBP Types Applicable to the Indonesian National Police with the background of the problem there is one of the people issuing SIM without following procedures and there are still extortion officers, and formulation of the problem First How is the PNBP process specifically for SIM C that applies at the Konsel Police Office, Second How is the PNBP implementation in this case making SIM C in the Konsel Polres, and third How is the Islamic Law Review towards the implementation of Government Regulation Number 60 Year 2016 in Konsel Polres. This study aims to determine the process of PNBP, implementation, and Review of Islamic Law in Government Regulation Number 60 Year 2016 at the Konsel Police Station. To answer this problem the writer uses descriptive-qualitative research using a juridical-empirical approach. The data collection methods that I use are library research and field research. Data sources that I use are observation, interviews, and documentation, using data analysis techniques, namely data reduction, data display, and data verification. Based on the results of the study showed that the first PNBP process in force at the Counseling Police Office was in accordance with applicable rules regarding the procedure for depositing PNBP. Both PNBP have not been implemented optimally because violations were still found such as there were still SIM makers not taking the test, and there were still illegal payments. Third, it is reviewed from Islamic Law that the PNBP process is in accordance with Islamic Law regarding PNBP deposit procedures, but its implementation is not yet optimal because there are still violations that are contrary to the principle of justice (QS An-Nisa: 135) and the principle of equality (QS Al-Hujurat: 13) . Ag Sebagai Pembimbing I Dan Bapak Drs. Muh. Idris Ma Sebagai Pembimbing II Penelitian ini membahas tentang Tinjauan Hukum Islam Terhadap Implementasi Peraturan Pemerintah Nomor 60 Tahun 2016 Tentang Jenis Dan Tarif Atas Jenis PNBP Yang Berlaku Pada Kepolisian Negara Republik Indonesia dengan latar belakang permasalahan ada salah satu masyarakat menerbitkan SIM tanpa mengikuti prosedur dan masih ada petugas yan pungli, dan rumusan masalahnya Pertama Bagaimana proses PNBP khusus SIM C yang berlaku dikantor Polres Konsel, Kedua Bagaimana implementasi PNBP dalam hal ini pembuatan SIM C di Polres Konsel, dan ketiga Bagaimana Tinjauan Hukum Islam terhadap implementasi Peraturan Pemerintah Nomor 60 Tahun 2016 di Polres Konsel. Penelitian ini bertujuan untuk mengetahui proses PNBP, implementasi, dan Tinjauan Hukum Islam dalam Peraturan Pemerintah Nomor 60 Tahun 2016 di Polres Konsel. Untuk menjawab permasalahan tersebut penulis menggunakan penelitian deskriptif-kualitatif dengan menggunakan pendekatan yuridis-empiris. Adapun metode pengumpulan data yang penulis gunakan adalah penelitian kepustakaan dan penelitian lapangan. Sumber data yang penulis gunakan adalah observasi, wawancara, dan dokumentasi, dengan menggunakan teknik analisis data yaitu reduksi data, display data, dan verifikasi data. Berdasarkan hasil penelitian menunjukkan bahwa pertama Proses PNBP yang berlaku dikantor Polres Konsel sudah sesuai dengan aturan yang berlaku mengenai tata cara penyetoran PNBP. Kedua PNBP belum terimplementasi secara maksimal karena masih ditemukan pelanggaran seperti masih ada pembuat SIM tidak mengikuti tes ujian, dan masih ada pungutan liar. Ketiga ditinjau dari Hukum Islam bahwa proses PNBP sudah sesuai dengan Hukum Islam mengenai tatacara penyetoran PNBP, namun implementasinya belum maksimal karena masih ditemukan pelanggaran yang bertentangan dengan prinsip keadilan (Q.S An-Nisa : 135) dan prinsip persamaan (Q.S Al-Hujurat : 13).
