Abstract

ABSTRACT RIRIN, NIM. 15030103009. "The Role of Forestry Police in Dealing with Illegal Logging in Review of Law No.41 of 1999 Perspective of Islamic Law Case Study in Wolasi Village, Wolasi Subdistrict, Konawe Selatan Regency" through Dr. Hj. Ipandang., M.Ag as supervisor I and Muh Asrianto Zainal SH. M.Hum as supervisor II Forest areas in Wolasi have high economic value so that some of their communities manage timber from the results of illegal logging or this if left unchecked, the forest areas in Wolasi will cause deforestation and impact on the community itself. In dealing with illegal logging, the forestry police are authorized as explained in Law No.41 of 1999 concerning Forestry. There are 3 problem formulations in this research, namely, one is how the conditions in the field of illegal logging in Wolasi Village, Wolasi District, Konawe Selatan District, two are the obstacles and the efforts of the forestry police in handling illegal logging in Wolasi Village, three Islamic law reviews on illegal logging in Wolasi Village. The purpose of this research is to answer the formulation of the problem in this study. This type of research is qualitative. This research was conducted with an empirical normative approach that uses primary data and secondary data. The results of this study illustrate that the current condition of forests in Wolasi Village is very worrying because some people in Wolasi village are carrying out illegal logging (Illegal Logging) as one of the people's livelihoods due to lack of jobs in the village. If Illegal Logging is carried out every day, the forest area will cause deforestation and other consequences so that it will have an impact on the community itself. Two factors and forestry police efforts in dealing with illegal logging are the first factor is the lack of official vehicles such as cars, lack of weapons, lack of members of the forestry police, funds, facilities and infrastructure and economic factors. then the efforts of the forestry police in dealing with illegal logging namely, providing socialization, re-greening, conducting surveillance in the forest area. Three reviews of Islamic Law concerning illegal logging, Jarimah illegal Logging is contrary to the Purpose of Islamic Law including preserving lives and protecting property. Illegal logging fingers are punished by ta'zir because they are not contained in the Koran. If illegal logging is punished ta'zir then the sentence is determined by the judge. In Indonesia ta'zir can be in the form of prisons, fines or confiscations. Ipandang., M.Ag sebagai pembimbing I dan Muh Asrianto Zainal SH. M.Hum sebagai pembimbing II Kawasan Hutan di Desa Wolasi memiliki nilai ekonomis yang tinggi sehingga sebagian masyarakatnya mengelola kayu dari hasil penebangan liar atau illegal logging hal ini jika dibiarkan terus menerus kawasan hutan di Desa Wolasi akan mengakibatkan kegundulan hutan dan berdampak pada masyarakat itu sendiri. Dalam menangani illegal logging polisi kehutanan di berikan wewenang sebagaimana di jelaskan dalam UU No.41 Tahun 1999 tentang Kehutanan Terdapat 3 rumusan masalah dalam penelitian ini yaitu, satu bagaimana kondisi dilapangan tentang illegal logging di Desa Wolasi Kecamatan Wolasi Kabupaten Konawe Selatan, dua apa kendala dan upaya polisi kehutanan dalam menangani illegal logging di Desa Wolasi, tiga tinjauan hukum islam tentang illegal logging di Desa Wolasi. Tujuan penelitian adalah untuk menjawab rumusan masalah yang ada dalam penelitian ini. Jenis penelitian ini adalah kualitatif. Penelitian ini dilakukan dengan pendekatan normatif empiris yang menggunakan data primer dan data sekunder. Hasil penelitian ini menggambarkan satu kondisi hutan di Desa Wolasi saat ini sangat mengkhawatirkan dikarenakan sebagian masyarakat di Desa Wolasi melakukan penebangan kayu secara liar (Illegal Logging) sebagai salah satu mata pencarian masyarakat dikarenakan kurangnya lapangan pekerjaan di Desa tersebut. Apabila Illegal Logging dilakukan setiap hari maka kawasan hutan tersebut akan mengakibatkan gundulnya kawasan hutan dan akibat lainnya sehingga akan berdampak pada masyarakat itu sendiri. Dua faktor dan upaya polisi kehutanan dalam menangani illegal logging pertama faktor kurangnya kendaraan dinas seperti mobil, tidak adanya kelengkapan senjata, kurangnya anggota polisi kehutanan, dana, sarana dan prasarana dan faktor ekonomi. kemudian upaya polisi kehutanan dalam menangani illegal logging yaitu, memberikan sosialisasi, melakukan penghijauan kembali, melakukan pengawasan diwilayah hutan. Tiga tinjauan Hukum Islam tentang illegal logging, Jarimah illegal Logging bertentangan dengan Tujuan Hukum Islam diantaranya memelihara jiwa dan memelihara harta. Jarimah illegal logging dihukumi ta’zir dikarenakan tidak terdapat dalam alqur’an. Jika jarimah illegal logging dihukum ta’zir maka hukumannya ditentukan oleh hakim. Di Indonesia ta’zir bisa berupa penjara, denda maupun penyitaan. Kata Kunci: Polisi Kehutanan, Illegal Logging, UU No.41 Tahun 1999, Tinjauan Hukum Islam
