Abstract

ABSTRAK Nama KAMILA WAFIQ AFIFAH. Nim. 17020101017. Problematika Proses Perceraian Adat Suku Tolaki Perspektif Al-Urf (Studi Desa Parasi Kec. Palangga Selatan Kab. Konawe Selatan). Dibimbing oleh: Jabal Nur, S.Ag., M.A., Perceraian adat suku Tolaki dilakukan dengan beberapa tahapan-tahapan, salah satunya dengan pembayaran denda. Denda tersebut dibebankan kepada pihak yang bersalah dengan nominal denda yang tidak sedikit. Sehingga membuat penulis tertarik untuk melakukan penelitian dengan judul Problematika Proses Perceraian Adat Suku Tolaki Perspektif Al-Urf. Tujuan penelitian ini untuk mendeskripsikan proses perceraian adat suku Tolaki di Desa Parasi Kecamatan Palangga Selatan Kabupaten Konawe Selatan dan mendeskripsikan perspektif al�urf mengenai proses perceraian adat suku Tolaki di Desa Parasi Kecamatan Palangga Selatan Kabupaten Konawe Selatan. Untuk menjawab permasalahan yang ada penulis menggunakan jenis penelitian kualitatif dengan pendekatan yuridis normatif. Adapun untuk menjelaskan persoalan secara mendalam dan menyeluruh, penelitian ini menggunakan sumber data primer dan sekunder. Teknik pengumpulan data dalam penelitian ini berupa observasi, interview dan dokumentasi. Kemudian proses adat tersebut diuraikan, dianalisis dan dibahas untuk menjawab permasalahan tersebut. Hasil penelitian ini menunjukan bahwa ada 6 tahapan yang dilalui dalam proses perceraian adat suku Tolaki dan adapun denda yang dikeluarkan yaitu kerbau, kain kafan, sarung dan cerek air minum. Kesimpulan dari penelitian ini adalah proses perceraian adat suku Tolaki termasuk kedalam urf shahih karena prosedur perceraian adat suku Tolaki bernilai maslahat agar mencegah terjadinya perceraian yang mudah. Problems with the Tolaki Tribe's Indigenous Divorce Process from the Al-Urf Perspective (Study of Parasi Village, South Palangga District, South Konawe Regency). Supervised by: Jabal Nur, S.Ag., M.A., The traditional Tolaki divorce is carried out in several stages, one of the stage was the payment of a fine. The fine is imposed on the guilty part with a nominal fine that was not small. It was makes the author interested in conducting the research paper with the title Problematic Divorce Process for the Tolaki Tribe from the Al-Urf Perspective. The purpose of this study was to describe the traditional Tolaki divorce process in Parasi Village, South Palangga District, South Konawe Regency. The al-urf's perspective on the Tolaki customary divorce process in Parasi Village, South Palangga District, South Konawe Regency. To answer the existing problems, the researcher used qualitative design with a normative juridical approach. As for explainetion of the problem in depth and thoroughly. This study used primary and secondary data sources, the techniques of data collection in this study used the form of observation, interviews and documentation. The customary process was described, analyzed and discussed the data to answer these problems. The results of this study indicate that there are 6 stages that is passing in the traditional Tolaki divorce process and as for the fines issued, namely buffalo, shroud, sarong and drinking a water kettle. The conclusion of this study was the traditional Tolaki divorce process is included in urf sahih because the Tolaki customary divorce procedure is beneficial in order to prevent an easy divorce.
