Abstract

ABSTRAK NAHMA, NIM. 16020101012, Perkawinan Tidak Tercatat Pada Masyarakat Bajo Perspektif Undang-Undang Nomor 16 Tahun 2019 (Studi Di Desa Torokeku Kecamatan Tinanggea Kabupaten Konawe Selatan). DIbimbing Oleh: Dr. Kamaruddin, S.Ag.,SH.,MH Penelitian ini membahas tentang masyarakat bajo yang melakukan perkawinan tidak tercatat yang tidak seseuai dengan Undang-Undang No. 16 tahun 2019 pasal 2 ayat 2. Dengan rumusan masalah ini adalah Bagaimana Deskriptif perkawinan tidak tercatat pada masyarakat Bajo di desa torokeku, dan Bagaimana Perspektif UU No. 16 Tahun 2019 Terhadap perkawinan yang tidak tercatat pada Masyarakat Bajo di Desa Torokeku. Bertujuan untuk mengetahui Bagaimana Deskriptif pekawinan tidak tercatat pada Masyarakat Bajo di Desa Torokeku dan Bagaimana perspketif Undang-Undang No. 16 Tahun 2019 terhadap perkawinan tidak tercatat masyarakat Bajo di Desa Torokeku. Penelitian ini menggunakan metode penelitian kualitatif yang bersifat deskriptif dengan tehnik menggumpulkan data, observasi, wawancara dan dokumentasi, adapun sumber datanya terdiri dari data primer dan data sekunder. Tehnik analisis menempuh langkah reduksi data, penyajian data dan menarik kesimpulan. Hasil penelitian menunjukkan bahwa Deskriptif Perkawinan tidak tercatat Masyarakat Bajo berjumlah 24 KK yang tidak tercatat dan 6 KK yang melakukan pencatatan. Proses perkawinan masyarakat suku bajo meliputi, peminangan (Pamassuroang), pemberian mahar (pamadutayyang doi), pertemuan tokoh adat (Pasitummung Ha’Toa Ada), Pernikahan (panikka’ang), Mengantar Penganting (Malimbah Botteh). Adapun Faktor Perkawinan Tidak Tercatatnya Pada Masyarakat Bajo antara lain; Faktor Ekonomi, Faktor pendidikan, Faktor Suka Sama Suka, Faktor Keluarga, Faktor Poligami, Faktor Kesadaran Masyarakat. Sedangkan Dampak Perkawinan Tidak Tercatat antara lain; Perkawinan dianggap tidak sah, Anak hanya mempunyai hubungan perdata dengan ibu dan keluarga ibu, Tidak mempunyai kekuatan hukum dalam hal status perkawinan. Perkawinan tidak tercatat pada masyakat bajo dalam perspektif undang-undang Nomor 16 Tahun 2019 Jika ditinjau dalam Perspektif Undang-Undang No.16 Tahun 2019 tentang Perkawinan tidak tercatat Masyarakat Bajo di desa torokeku kecamatan tinanggea kabupaten konawe selatan. Belum sesuai dengan pasal 2 ayat 2 yang dimana tiap-tiap perkawinan dicatat menurut perundang-undangan yang berlaku, sedangkan yang terjadi dilapangan masih banyak perkawinan yang tidak tercatat di KUA, Jadi perkawinan yang terjadi pada masyarakat suku bajo di desa torokeku berdasarkan uu no 16 tahun 2019 pasal 2 ayat 2 tentang perkawinan tidak di benarkan dan tidak sah secara hukum di Indonesia. vii ABSTRACT NAHMA, NIM. 16020101012, Undocumented Marriages in the Bajo Community Perspective of Law Number 16 of 2019 (Study in Torokeku Village, Tinanggea District, South Konawe Regency). Supervised by: Dr. Kamaruddin, S.Ag., SH., MH This research discusses the Bajo people who carry out unregistered marriages that are not in accordance with Law No. 16 of 2019 article 2 paragraph 2. With the formulation of this problem is How the descriptive marriage is not recorded in the Bajo community in Torokeku village, and What is the Perspective of Law No. 16 of 2019 on marriages that are not recorded in the Bajo Community in Torokeku Village. Aims to find out how descriptive marriage is not recorded in the Bajo community in Torokeku Village and what is the perspective of Law No. 16 of 2019 regarding marriages are not recorded by the Bajo community in Torokeku Village. This research uses descriptive qualitative research methods with techniques for collecting data, observation, interviews and documentation, while the data sources consist of primary data and secondary data. Analysis techniques take steps to reduce data, present data and draw conclusions. The results showed that the descriptive marriage was not recorded. The Bajo community totaled 24 families who were not recorded and 6 families who took notes. The marriage process of the Bajo ethnic community includes, marriage (Pamassuroang), giving a dowry (pamadutayyang doi), meeting traditional leaders (Pasitummung Ha'Toa Ada), marriage (panicka'ang), Mengantar Penganting (Malimbah Botteh). The factors of unrecorded marriage in the Bajo community, among others; Economic factors, educational factors, consensual factors, family factors, polygamy factors, community awareness factors. While the impact of an unregistered marriage, among others; Marriage is considered invalid, the child only has a civil relationship with the mother and the mother's family, does not have legal force in terms of marital status. Marriage is not recorded in the Bajo community in the perspective of law Number 16 of 2019 If viewed in the Perspective of Law No. 16 of 2019 concerning Marriage, the Bajo community in Torokeku village, Tinanggea sub-district, South Konawe district, is not recorded. Not in accordance with article 2 paragraph 2, where every marriage is recorded according to the applicable laws, while what happens in the field there are still many marriages that are not recorded at the KUA, so marriages that occur in the Bajo tribe in Torokeku village are based on Law No. 16 years 2019 article 2 paragraph 2 concerning marriage is not justified and legally illegal in Indonesia.
