Abstract

ABSTRAK Judul : Penelitian ini berjudul Poligami Siri Perspektif Maslahat (Studi Perkara Nomor 167/Pdt.G/2019/Pa Rmb) dengan rumusan masalah : Bagaimana fenomena poligami siri dalam Perkara Nomor 167/Pdt.G/2019/PA Rmb? Bagaimana Pertimbangan Hakim dalam poligami siri dalam Perkara Nomor 167/Pdt.G/2019/PA Rmb.? dan Bagaimana perspektif maslahat terhadap poligami siri dalam Perkara Nomor 167/Pdt.G/2019/PA Rmb. ?. Tujuan penelitian ni adalah untuk mengetahui fenomena poligami siri dalam Perkara Nomor 167/Pdt.G/2019/PA Rmb disamping untuk mengetahui dan menganalisis poligami siri perspektif maslahat. Untuk menjawab Permasalahan tersebut penulis menggunakan metode penelitian yuridis empiris dan menggunakan pendekatan Perundang-undangan dan pendekatan kasus, menganalisi perundang-undangan dengan sumber data primer dan data skunder dan teknik pengumpulan data observasi wawancara dan dokumentasi.Adapun tekhnik analisis data yaitu data reduction (reduksi data), data display (display data) dan conclusion drawing/verification (kesimpulan). Hasil penelitian ini adalah : Pertama bahwa fenomena pernikahan poligami siri dalam perkara tersebut terdapat Para Penggugat yang merasa dirugikan sehingga mengajukan gugatan mal waris terhadap istri yang dipoligami secara siri. Kedua bahwa pertimbangan hakim dalam Perkara tersebut yang menyatakan bahwa perkawinan poligami siri tidak menimbulkan hubungan hukum sehingga tidak bisa saling mewarisi. Ketiga bahwa Poligami siri dalam perspektif maslahat banyak menimbulkan akibat hukum yang tidak sesuai dengan maslahat terutama maslahat terkait hak-hak keperdataan, termasuk di dalamnya adalah maslahat terhadap harta. Dengan penelitian ini, peneliti mengharapkan poligami siri tidak terjadi lagi di tengah kehidupan masyarakat karena dampaknya sangat merugikan suami/istri dan keturunannya. What is the Judge's Consideration in Unofficial polygamy in Case Number 167 / Pdt.G / 2019 / PA Rmb. and What is the maslahat perspective on unofficial polygamy in Case Number 167 / Pdt.G / 2019 / PA Rmb. The purpose of this study was to determine the phenomenon of unofficial polygamy in Case Number 167 / Pdt.G / 2019 / PA Rmb in addition to knowing and analyzing unofficial polygamy with a maslahah perspective. To answer these problems, the authors use empirical juridical research methods, use the statutory approach and the case approach, analyze legislation with primary data sources and secondary data, as well as data collection techniques, interview observation and documentation. The data analysis techniques are data reduction, data display and conclusion drawing / verification. The results of this study are: First, that the phenomenon of siri polygamous marriage in this case there are plaintiffs who feel aggrieved so that they file a mal inheritance lawsuit against their polygamous wife. Second, that the judge's consideration in the case stated that a siri polygamous marriage did not create a legal relationship so that it could not be mutually inherited. Third, Siri polygamy in the perspective of maslahat has many legal consequences that are incompatible with maslahat, especially maslahat related to civil rights, including the benefit of property. With this research, the researchers hope that unofficial polygamy will not happen again in the community because the impact is very detrimental to husband / wife and their offspring.
