Abstract

ABSTRAK Mislu Zaini. NIM. 17020103039. Analisis Kebijakan Mutasi Aparatur Sipil Negara (ASN ) di Pemerintahan Daerah Kabupaten Muna Pasca Pemilihan Kepala Daerah Tahun 2020 Berdasarkan Undang-undang Nomor 10 Tahun 2016 Perspektif Fiqh Siyasah. Dibimbing oleh: Dr. Hj. Ipandang., M.Ag, Irma Irayanti, S.HI.,M.Pd. Mutasi Pegawai Aparatur Sipil Negara merupakan manajemen Aparatur Sipil Negara yang terjadi dalam suatu organisasi Atau Instansi Pemerintahan, kebijakan mutasi yang dilakukan pasca Pemilihan Kepala Daerah di Kabupaten Muna dinilai sebagai fenomena teknis administratif dan politis. Tujuan penelitian ini yaitu (1)Mengidentifikasi mekanisme mutasi pasca Pemilihan Kepala Daerah di Kabupaten Muna; (2) Mengidentifikasi implikasi hukum kebijakan mutasi ASN pasca Pemilihan Kepala Daerah di pemerintahan Kabupaten Muna dengan berdasarkan Pasal 72 ayat (2 )Undang-Undang nomor 10 tahun 2016 (3) Mengidentifikasi pandangan Fiqh Siyasah mengenai Kebijakan Mutasi ASN pasca Pemilihan Kepala Daerah di Pemerintahan Daerah Kabupaten Muna. Metode penelitian menggunakan metode penelitian hukum Normatif dengan teknik pengumpulan data yaitu (1) Observasi; (2)Studi Wawancara; (3 ) Studi Dokumen. Hasil penelitian ini menunjukkan bahwa (1 ) Dalam pelaksanaannya mutasi yang diakukan pasca Pemilihan Kepala Daerah berdasarkan pada kebutuhan pegawai di suatu kantor pegawai Aparatur Sipil Negara, hal tersebut dilakukan untuk pendistribusian Pegawai Aparatur Sipil Negara secara merata dan adil; (2) Pelaksanaan mutasi sesuai undang-undang, mutasi dilakukan pada pejabat fungsional sedangkan yang dimaksud pada pasal 72 Undang-undang nomor 10 tahun 2016 yaitu pejabat struktural dan pejabat fungsional yang mendapatkan tugas tambahan; (3) Sedangkan kebijakan Mutasi dalam Fiqh Siyasah boleh dilakukan karena secara eksplisit ajaran Fiqh Siyasah tidak mengatur tentang mutasi tetapi dalam sejarah Islam secara fiqh pergantian pejabat sudah dilakukan di zaman Rasulullah Muhammad SAW hingga ke khalifahan Umar Bin Al-khatab. Policy Analysis of State Civil Apparatus Transfers (ASN ) in Muna Regency Regional Government Post Regional Head Elections in 2020 Based on Law Number 10 of 2016 Fiqh Siyasah Perspective. Supervised by: Dr. Hj. Ipandang., M.Ag, Irma Irayanti, S.HI., M.Pd. Mutation of State Civil Apparatus Employees is the management of the State Civil Apparatus that occurs in an organization or government agency, the mutation policy carried out after the Regional Head Election in Muna Regency is considered a technical administrative and political phenomenon. The aims of this study are (1) to identify the mechanism for post-election mutations in Muna Regency; (2) Identifying the legal implications of the ASN mutation policy after the Regional Head Election in the Muna Regency government based on Article 72 paragraph (2) of Law number 10 of 2016 (3) Identifying Fiqh Siyasah's views regarding the ASN Mutation Policy after the Regional Head Election in Regional Government Muna District. The research method uses normative legal research methods with data collection techniques, namely (1) observation; (2) Interview Study; (3) Document Study. The results of this study indicate that (1) In practice, the mutations carried out after the Regional Head Election are based on the needs of employees in a State Civil Apparatus employee office, this is done for the distribution of State Civil Apparatus Employees evenly and fairly; (2) Implementation of mutations according to the law, mutations are carried out on functional officials while what is meant in Article 72 of Law number 10 of 2016 are structural officials and functional officials who get additional tasks; (3) While the Mutation policy in Fiqh Siyasah may be carried out because the teachings of Fiqh Siyasah explicitly do not regulate mutations, but in Islamic history, fiqh changes of officials have been carried out from the time of the Prophet Muhammad to the caliphate of Umar Bin Al-Khattab.
