Abstract

ABSTRAK St. Rafi’ah Amir. 18020102042. Program Studi Hukum Ekonomi Syariah Institut Agama Islam Negeri (IAIN) Kendari. Penyelesaian Sengketa Rahn Tasjily Melalui Gugatan Sederhana di Pengadilan Agama Andoolo (Studi Putusan Nomor 0001/Pdt.GS/2020/PA.Adl). Dibimbing oleh : Dr. Kamaruddin, S.Ag.,S.H.,M.H. dan La Ode Muhammad Iman Abdi Anantomo Uke, S.H.,M.H. Penyelesaian sengketa Rahn Tasjily melalui Gugatan Sederhana di Pengadilan Agama Andoolo (Studi Putusan Nomor 0001/Pdt.GS/2020/PA.Adl) merupakan penelitian yang dilakukan dengan tujuan untuk mengkaji status akad Rahn Tasjily di Pegadaian Syariah (Cabang) Kendari serta mengetahui bagaimana sengketa tersebut diselesaikan melalui gugatan acara sederhana di Pengadilan Agama Andoolo. Teknik penelitian ini menggunakan teknik penelitian kualitatif dengan jenis penelitian hukum empiris, serta menggunakan pendekatan penelitian studi kasus, data dikumpulkan dengan cara observasi, dokumentasi dan wawancara serta diolah dengan cara direduksi, dikaji lalu diverifikasi. Hasil penelitian menunjukkan bahwa : status akad Rahn Tasjily yang dilakukan di Pegadaian Syariah (Cabang) Kendari sah menurut hukum, baik hukum nasional maupun hukum Islam sebab unsur serta syarat-syarat akad perjanjian terpenuhi. Oleh karena terjadi wanprestasi ditengah jalannya perjanjian maka pihak yang dirugikan mengajukan gugatan ke Pengadilan Agama Andoolo melalui gugatan acara sederhana. Melalui putusannya, dengan menuangkan beberapa pertimbangan, Hakim telah mengadili sengketa Rahn Tasjily tersebut dengan mengabulkan tuntutan Penggugat sebagian. Rahn Tasjily's dispute resolution through a small claim court at the Andoolo Religious Court (Judgment Study Number 0001/Pdt.GS/2020/PA.Adl) is a study conducted with the aim of assessing the status of Rahn Tasjily's contract at sharia pawnshop (Branch) Kendari and knowing how the dispute is The case was resolved through a simple lawsuit at the Andoolo Religious Court. This research technique uses qualitative research techniques with the type of empirical legal research, and uses a case study research approach, data is collected by means of observation, documentation and interviews and processed by means of reduction, review and verification. The results showed that: the status of Rahn Tasjily's contract which was carried out at sharia pawnshop (Branch) Kendari was legal according to law, both national law and Islamic law because the elements and conditions of the agreement were fulfilled. Because there was a default in the middle of the agreement, the aggrieved party filed a lawsuit with the Andoolo Religious Court through a simple lawsuit. Through his decision, by pouring out several considerations, the Judge has tried the Rahn Tasjily dispute by partially granting the Plaintiff's demands.
