Abstract

ABSTRAK Sahlan (NIM : 16040203023) Legalitas Tanah Wakaf di Kabupaten Muna (Studi Kasus Terhadap Fasilitas Publik Dibawah Naungan Kantor Kementerian Agama Kabupaten Muna) Dibimbing oleh Dr. Husain Insawan, M.Ag dan Dr. Kamaruddin, S.Ag,. SH., MH Wakaf merupakan aset publik, yang menjadi harapan besar masyarakat untuk dikelola dan dimanfaatkan secara optimal walaupun dalam pelaksanaan wakaf dilapangan masih banyak dilakukan secara konvensional, peran kantor urusan agama kecamatan sangat penting dalam pelaksanaan legalisasi tanah wakaf, umumnya tanah wakaf di kabupaten Muna diperuntukkan untuk mesjid, mushalla, sekolah, makam, pondok pesantren dan sosial lainnya yang tersebar merata diseluruh kecamatan di Kabupaten Muna. Penelitian ini mengangkat persoalan legalisai tanah wakaf dan kendala yang dihadapi serta solusi legalisasi tanah wakaf, penelitian ini bertujuan untuk memahami pelaksanaannya di wilayah kerja Kantor Kementerian Kabupten Muna. Penelitian ini menggunakan metode yuridis empiris, spesifikasi penelitian bersifat deskriptif analitis, Penelitian ini menggambarkan apa adanya keadaan lapangan, sedangkan tehnik penentuan sample yang digunakan adalah purpossive sampling dengan tehnik pengumpulan data berdasarkan pada data primer dan sekunder serta didukung oleh daftar perpustakaan. Hasil penelitian menunjukkan bahwa pelaksanaan legalisasi tanah wakaf fasilitas publik dibawah naungan Kantor Kementerian Agama Kabupaten Muna adalah 1) umumnya tidak mengikuti prosedur yang telah ditetapkan pemerintah melalui UU wakaf sehingga membuka kemungkinan terjadinya sengketa dikemudian hari serta mengakibatkan terancamnya tanah wakaf 2) proses penanganan wakaf pada KUA Kecamatan di Kabupaten Muna menetapkan prosedur perwakafan yang relatif sama antara satu KUA dengan KUA lainnya. Problematika yang dihadapi dalam upaya legalisasi tanah wakaf fasilitas publik dibawah naungan Kantor Kementerian Agama Kabupaten Muna adalah 1) Kurangnya kesadaran dari wakif untuk menyertifikasi tanah wakaf 2) Hilangnya surat-menyurat tanah milik wakif atau belum diserahkannya oleh kecamatan induk 3) Minimnya anggaran dalam DIPA Kantor Kementerian Agama (Seksi Bimas Islam) untuk pengurusan sertifikasi tanah wakaf; 4) Minimnya SDM yang secara khusus menangani bidang perwakafan; 5) Minimnya pengarsipan dokumen perwakafan. Solusi terhadap problematika legalisasi tanah wakaf fasilitas publik dibawah naungan Kantor Kementerian Agama Kabupaten Muna adalah 1) sosialisasi kepada masyarakat tentang pentingnya sertifikasi tanah wakaf: 2) Koordinasi yang lebih baik diantara instansi yang berwenang, 3) peningkatan kemampuan profesional petugas wakaf, 4) peningkatan anggaran dalam urusan perwakafan, 5) Penguatan sinergitas antar lembaga pemerintah dan antar pemerintah dengan tokoh agama dan masyarakat untuk percepatan program sertifikasi tanah wakaf di Muna. SH., MH The Waqf is a public asset, which became the great hope society for dimanfaatakan and managed optimally even in the execution of the Waqf, the situation is still much done conventionally, the role of the Office of religious affairs of the subdistrict is very important in the implementation of the legalization of land endowments, generally land endowments in the Regency Muna cater to mosques, schools, tombs, mushalla, boarding schools and other social which is fairly spread throughout the town in Muna. This research raised the question of legalisai land endowments and constraints faced and the solutions the legalization of land endowments, this research aims to understand the implementation in the region Office Ministry Muna County. This study uses empirical juridical method, specification descriptive analytical nature of the research, this research describes as the State of the field, whereas the method of determining the sample used was sampling with purpossive method data collection based on the primary and secondary data and supported by the library list. Results showed that the implementation of the land legalisation of Waqf public facilities under the Office of the Ministry of Religious Affairs of Muna Regency is 1) generally do not follow the procedures that have been established by the Government of Waqf law so Open the possibility of disputes in the day and resulted in the discovery of the Land Waqf 2) the process of handling Waqf in the office of Religious Affairs Kecamatan in Muna District set the representative procedure relatively similar between one office Religious affairs with other Office of religious Affairs. Problematics faced in the efforts of the land legalisation of Waqf public facilities under the Office of the Ministry of Religious Affairs of Muna Regency is 1) lack of consciousness from wakif and Nazhir to certify Waqf Land 2) loss of land correspondence Owned by Wakif or have not been handed over by the Sub-District 3) lack of budget in DIPA for the management of Waqf land certification; 4) Lack of human resources specifically dealing with the field of Representatives; 5) Minimum filing of Waqf documents.
