Abstract

This thesis discusses the problem of the implementation of zakat on profession among the civil servants of Tulungagung within the broader notion of its position as a religious obligation, and with particular reference to the official decree of the local government concerning zakat implementation as well as the interpretation of the ‘ulama on it. The thesis believes that a study of this kind is of urgent nature considering that it stresses the necessity of enhancing the economic prosperity of the masses. In principle, the thesis theoretically speaking-tries to bring to light the modes and behaviors of those who reject zakat payment and those who accept it. This-the thesis would try to show-does have the direct social and spiritual implication, if seen purely from the perspective of positive law. To achieve its goal, the thesis employs the sociological approach which includes such processes as legitimization, selection, functioning, and social organization. The nature of the object under investigation is very much internal having to do a lot with the experiences of individuals, and not external. The data of the research are acquired by means of participative observation and interview in addition to the documentation of events. The latter is done in a way that things related to the issue in hand may be analyzed properly and appropriately. Upon a careful analysis, the thesis comes to understand that there has been a shift in the implementation of zakat payment among the civil servants of Tulungagung, the way they understand it as religious obligation as well as the moods whereby they pay zakat to the Zakat Authoritative Body BAZ. All this is due-the thesis discovers-to the way they understand the religious bases for the obligation of zakat, the different perception on the official decree of the local government on zakat payment and the applicability of the views of the previous ulama concerning the obligation of zakat. These differences become more apparent when one looks at the mechanism of zakat payment at the Zakat Collecting Body UPZ and BAZ where these two organizations employ different sets of policy as far as zakat payment is concerned. On the part of the central government, there has been a positive gesture whereby the government has issued a decree number 38 in the year 1999 concerning the regulations of zakat; regulations that may be said as reflecting the religiosity of the Indonesian people as a whole as far as obeying the religious commands and abiding to the national law is concerned.
