Abstract

ABSTRAK NARTI, NIM.19040203001. Autokritik Implementasi UU No. 16 Tahun 2019 terhadap Dispensasi Kawin di Pengadilan Agama Kendari Perspektif Maslahah Mursalah. Dibimbing Oleh:Dr. Ashadi L.Diab, MA.,M.Hum (sebagai Pembimbing I) dan Dr. H. Ahmad Lc.,M.HI (sebagai Pembimbing II) Penelitian ini bertujuan untuk mengetahui problematika Dispensasi kawin pasca terbitnya Undang-Undang Nomor 16 Tahun 2019 di Pengadilan Agama Kendari, Untuk mengetahui autokritik dampak Dispensasi kawin pasca terbitnya Undang-Undang Nomor 16 Tahun 2019 di Pengadilan Agama Kendari. dan Untuk mengetahui pertimbangan majelis hakim dalam menetapkan permohonan Dispensasi kawin pasca terbitnya Undang-Undang Nomor 16 Tahun 2019 di Pengadilan Agama Kendari ditinjau dalam perspektif maslahah mursalah.Data dikumpulkan melalui Observasi, wawancara dan dokumentasi. Selanjutnya data yang ada dianalisis. Hasil penelitian menunjukkan bahwa Problematika Dispensasi kawin pasca terbitnya Undang-Undang Nomor 16 Tahun 2019 di Pengadilan Agama Kendari dapat dilihat dari beberapa faktor yakni faktor keluarga, pergaulan bebas dan kurangnya sosialisasi pemerintah setempat kepada masyarakat.Autokritik Dampak Dispensasi kawin pasca terbitnya Undang-Undang Nomor 16 Tahun 2019 di Pengadilan Agama Kendari terdiri dari dampak positif yakniMeminimalisir terjadinya perkawinan Dini, Meminimalisir terjadinya perceraian, Melindungi Alat Reproduksi Wanita dan Mencegah pergaulan bebas sedangkan dampak negatifnya adalah Banyak yang melakukan kawin siri, Jumlah perkara dispensasi kawin meningkat. Sedangkan Pertimbangan majelis hakim dalam menetapkan permohonan Dispensasi kawin pasca terbitnya Undang-Undang Nomor 16 Tahun 2019 di Pengadilan Agama Kendari ditinjau dalam perspektif maslahah mursalah adalah untuk melihat manfaat dari penetapan perkara dispensasi kawin maka hakim mempertimbangkan Agama, Pendidikan, ekonomi dan kesehatan. Ahmad LC., M.HI (as a supervisor II) This study aims to determine the problem of marriage dispensation after the issuanceof Law Number 16 of 2019 in the Kendari Religious Court, to determine the autocrism of the impact of marriage dispensation after the issuance of Law Number 16 of 2019 in the Kendari Religious Court. And to find out the consideration of the panel of judges in determining the ask for marriage dispensation after the issuance of Law Number 16 of 2019 in the Kendari Religious Court reviewed in the perspective of Maslahah mursalah. Data is collected through observation, interviews and documentation. Then the existing data was analyzed. The results showed that the problem of marriage dispensation after the issuance of Law Number 16 of 2019 in the Kendari Religious Court could be seen from several factors namely family factors, free association and lack of socialization of local governments to the public. Autocritic impact dispensation of marriage after the issuance of Law Number 16 of 2019 in the Kendari Religious Court consisting of positive impacts, namely minimizing the occurrence of early marriage, minimizing the occurrence of divorce, protecting female reproductive tools and preventing free association while the negative impact is many who do siri marriages, numbers The mating dispensation case increases.
