Abstract

ABSTRAK Fira L. NIM 17050101109. Implementasi Sistem Gadai Tambak Dalam Perspektif Ekonomi Islam (Studi Desa Lalonggombu Kecamatan Lainea Kabupaten Konawe Selatan). Dibimbing oleh Dr. Muhammad Hadi, M.HI & Nurjannah S.Kom, M.Pd., Penelitian ini bertujuan untuk mengetahui Implementasi sistem gadai tambak di Desa Langgombu, Kecamatan Lainea, Kabupaten Konawe Selatan, faktor apa saja yang memengaruhi masyarakat sehingga menggadaikan tambak miliknya dan bagaimana perspektif ekonomi islam terhadap praktik gadai tersebut. Jenis penelitian ini adalah kualitatif deskriptif dengan pendekatan studi kasus, pengumpulan data ,enggunakan metode pengamatan terlibat, wawancara dan Studi Dokumentasi. Dengan pengujian keabsahan data menggunakan triangulasi sumber, tiangulasi teknik, dan triangulasi waktu. Berdasarkan hasil penelitian menunjukan bahwa Implementasi sistem gadai tambak di Desa Langgombu, Kecematan Lainea, Kabupaten Konawe Selatan, dalam penentuan besaran harga gadai tidak ditentukan oleh seberapa luas tambak yang akan menjadi barang jaminan, tetapi didasarkan pada berapa kebutuhan uang pihak pemberi gadai hingga ada kesepakatan besaran uang dari penerima gadai. Berakhirnya akad gadai ketika penggadai menyerahkan uang kepada penerima gadai sesuai jumlah yang dipinjam. Umumnya akad yang dilakukan adalah akad tolong menolong dengan kesepakatan lisan dan aturannya berdasarkan hukum adat (kebiasaan) yang berlaku tentang luas tambak serta jumlah uang yang diperlukan dan masa gadainya. Faktor-faktor yang memengaruhi sehingga masyarakat menggadaikan tambak miliknya secara umum dilatar belakangi karena gagal panen yang dialami secara terus menerus oleh petani tambak, sehingga para petani kehabisan modal untuk mengolah ulang tambak miliknya. Sistem gadai tambak di Desa Langgombu, Kecematan Lainea, Kabupaten Konawe Selatan, jika dilihat dari rukun dan syarat sahnya akad tersebut tidak sah berdasarkan hasil penelitian dari beberapa atau sebagian masyarakatnya. Setelah terjadi akad gadai, maka penguasaan/pemanfaatan ditangan penerima gadai, hal ini bertentangan dengan hukum Islam/Fiqhi Muamalah yang mengaharuskan penguasaan/pemanfaatan berada ditangan penggadai. This type of research is descriptive qualitative with a case study approach, data collection, using involved observation methods, interviews and Documentation Studies. Based on the results of the study, it was shown that the implementation of the pond pawning system in Langgombu Village, Lainea District, South Konawe Regency, in determining the amount of the pawn price is not determined by the size of the pond that will become collateral, but is based on how much money the pawner needs until there is an agreement on the amount. money from the mortgagee. The end of the pawn contract when the pawner hands over the money to the pawnee according to the amount borrowed. Generally, the contract made is a mutual assistance contract with an oral agreement and the rules are based on the applicable customary law (custom) regarding the size of the pond as well as the amount of money needed and the period of the pledge. The factors that influence so that people pawn their ponds are generally due to crop failures experienced by pond farmers continuously, so that farmers run out of capital to rework their ponds. The pawn pond system in Langgombu Village, Lainea District, South Konawe Regency, when viewed from the pillars and legal requirements of the contract is invalid based on the results of research from some or part of the community. After the pawn contract occurs, the control/utilization is in the hands of the pawnee, this is contrary to Islamic law/Fiqhi Muamalah which requires the control/utilization to be in the hands of the pawnbroker.
